The State of Montana has laid out a very specific system for expunging a misdemeanor crime from a person’s record. This system involves petitioning the Montana State District Court for an order expunging qualified misdemeanor records. The Petitioner’s expungement attorney has some obligations to notify the prosecution, who in turn notifies all potential victims. The District Court then makes a determination.
If granted, the Petitioner must provide a new set of fingerprints, the Expungement Form, and the Court Order to CRISS in Helena. CRISS then verifies everything. If all is fine, CRISS will remove the arrest and/or conviction data from the system. The process takes about 30 days.
