What type of criminal records can be expunged?

Which criminal records are NOT eligible for expungement?

Felonies cannot be expunged, other than marijuana crimes. Marijuana-related felonies are eligible for expungement in Montana as well.

The Expungement Process

The Montana legislature passed a Bill in 2017 that entitles individuals to petition the District Court to expunge misdemeanor convictions. Felony marijuana charges are also expungement-eligible. Expungement has certain requirements:

  • The individual is not currently entangled in pending charges for a new offense.
  • The individual has not been convicted of any other offense in Montana or elsewhere for five years since completing the original sentence, including having paid all financial obligations or completing court-ordered treatment.
  • These requirements may be waived if the individual has applied to a US military academy or to enlist in the armed forces or national guard, or is currently serving in the military and prohibited from enlisting or holding a certain position because of this prior conviction.

Additional Expungement Rules

An individual can and should petition for expungement of all misdemeanor offenses at the same time. However, the expungement process is available to each individual only one time in the person’s lifetime.

The person seeking expungement must provide a set of fingerprints for identity verification.

How Expungement Works

The State of Montana has laid out a very specific system for expunging a misdemeanor crime from a person’s record. This system involves petitioning the Montana State District Court for an order expunging qualified misdemeanor records. The Petitioner’s expungement attorney has some obligations to notify the prosecution, who in turn notifies all potential victims. The District Court then makes a determination.

If granted, the Petitioner must provide a new set of fingerprints, the Expungement Form, and the Court Order to CRISS in Helena. CRISS then verifies everything. If all is fine, CRISS will remove the arrest and/or conviction data from the system. The process takes about 30 days.
